Disposal terms
Draft for legal review, dated 31 October 2026. These terms have not yet been reviewed by a solicitor.
These terms apply when you ask Box 4 Digital Group Ltd to arrange a chemical or laboratory waste collection, through this website, by phone or email, or through the Chemical Register.
1. Parties and what each one does
Box 4. "Box 4", "we" and "us" mean Box 4 Digital Group Ltd, company number 17253991, Suite 114b Business First, Davyfield Road, Blackburn, Lancashire BB1 2QY. Waste broker registration number [TO CONFIRM]. VAT number [TO CONFIRM].
Box 4 quotes you a price, arranges collection through a registered hazardous waste carrier, handles the paperwork we describe below, and invoices you. Box 4 does not transport, hold or treat waste, and does not take possession of it at any time. We pay the carrier we engage for your job.
You. "You" are the establishment named on the quote. You remain responsible for the duties that apply to you as producer or holder of the waste, including any that continue after collection.
The carrier and the consignee. The carrier collects and transports your waste under its own registration. The consignee is the permitted site that receives it. Each has its own legal duties, which we do not take over.
2. Quotes
A quote is itemised and shows waste codes, hazardous flags, totals excluding VAT, VAT, the total and a validity date. It is based on the information you gave us. It is not binding on us after its validity date. We will not issue a quote until our waste broker registration number has been set.
A minimum order value applies before a quote can be issued. It is currently £750 excluding VAT. We may change it for future quotes.
A contract is formed when you accept the quote, in the Chemical Register or in writing. If your organisation uses an approver, acceptance happens after approval.
3. Items outside the standard route
We do not quote the following by the standard route: controlled drugs, radioactive sources, explosives (including dried picric acid and other chemicals flagged as unstable), compressed gas cylinders, asbestos and unknown substances that cannot be placed with confidence. They go to a manual enquiry, and we may recommend a chemical store assessment. Listing these items does not commit us to arranging their removal.
Collections in Northern Ireland are handled as a manual enquiry for now.
4. Your responsibilities
As producer or holder of the waste you must:
- describe the waste accurately and tell us what you know about it, including anything unknown, leaking, damaged, old or unstable
- classify your waste. We may show codes to help you, but you remain responsible for an accurate description and for checking any code on your paperwork
- keep the waste safely stored and separated until it is collected. You must not mix hazardous waste with non-hazardous waste, or mix different categories of hazardous waste
- not open, decant or move anything for the collection unless the job plan says so
- give safe access on the agreed date, and tell us about access limits, stairs, lifts, restricted hours or other hazards on site
- make sure someone authorised to sign is present. In England, the consignor must be present at the collection
- check the consignment note before signing it, and keep your copy. Parts of the note cannot be changed after signature
- hold any premises registration that applies to you. In Wales, premises producing or storing over 500 kg of hazardous waste a year must register with Natural Resources Wales. In Scotland, a consignment code from SEPA and pre-notification may be needed
- check the registration of the carrier and the permit of the consignee shown on the note, before the waste moves
- keep your records for at least the period the law requires. In England that is three years at the premises that produced or stored the waste
Our consignment note guide sets these out by nation. It is general information and not legal advice.
5. Paperwork
On acceptance we prepare a pre-filled consignment note for England, Wales or Scotland. It names the carrier and the consignee. We do not publish carrier names beyond what the note and the law require. You agree to treat carrier details and their prices as confidential, except where you need to share them to meet your legal duties or a public body's rules.
Signed documents will be kept with your collection in the Chemical Register if you use it, or provided to you if you do not. Consignment notes and disposal records in the Chemical Register are retained for a minimum of three years. Users in your organisation can archive them but cannot delete them.
6. Dates
You give a preferred window. We work to arrange the collection within it, but dates depend on the carrier and on the requirements above, including any pre-notification period. A date is only fixed once it has been confirmed to you. We do not promise response times.
7. If the job differs from the quote
The carrier may check what is on site before collection. If the waste differs from the description, if there is more or less of it, if an item is unsafe to move or if a carrier cannot accept it, then:
- we may give you a revised price, which you can accept or decline
- an item may be left on site for separate handling
- additional work, or a further visit, may be charged at the rate we quote you
The carrier or consignee may refuse or reject waste where it reasonably considers that it cannot lawfully or safely take it. If a consignee rejects a load because of an inaccurate description, the cost of dealing with that rejected load falls on you. Any charges will be quoted or explained to you.
8. Cancellation
If you cancel or change a confirmed collection, or the carrier cannot get access on the agreed date, cancellation charges may apply. The charge and notice period are [TO CONFIRM].
We may cancel a job if a carrier becomes unavailable or the job cannot lawfully or safely go ahead. We will refund anything you have paid for work not carried out, and we will have no further liability for the cancellation.
9. Price and payment
Prices are as shown on the quote. We invoice you. You pay by BACS, against our invoice, with your purchase order number on it if you use them. We do not take card payments. Payment terms are [TO CONFIRM] days from the invoice date. Whether payment is due before or after collection is [TO CONFIRM].
We may charge interest on late payment and recover costs as the law allows.
10. Waste ownership and risk
We do not take title to, possession of or responsibility for storing your waste. Risk and title to the waste pass from you to the carrier, or as the law and the note provide, at the point of transfer. Items that are left on site remain yours. [TO CONFIRM with solicitor.]
11. Insurance
Our own insurance is [TO CONFIRM]. Carriers are required by our supplier terms to hold their own insurance. Please ask if you need evidence for your own procurement records.
12. Liability
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot legally be limited.
Subject to that:
- we are responsible for using reasonable care and skill in arranging your collection through a carrier that, on the information available to us, is registered
- you are responsible for losses caused by an inaccurate description, or by information you withheld, including rejected loads, damage and clean-up costs
- we are not liable for loss of profit, loss of business or indirect or consequential loss
- our total liability for any job is limited to [TO CONFIRM]
Using us does not transfer your duty of care. You retain the duties the law places on you as producer or holder.
13. Complaints
If something goes wrong on a job, tell us as soon as you can, using the contact details on this site. If an incident on site needs emergency help, call 999 first.
14. General
These terms and the quote make up the whole agreement for a collection. If part of them is unenforceable, the rest continues. Neither party is liable for delay caused by events outside its reasonable control. Nobody other than you and Box 4 has rights under these terms, including the carrier.
These terms are governed by the law of England and Wales, and its courts have jurisdiction, except where mandatory rules for a public body or a collection in Scotland or Northern Ireland say otherwise. [TO CONFIRM with solicitor.]
